** ОБЫЧАИ (правовой) - исторически сложившееся в определенном обществе (или местности) правило поведения, которое взято под охрану государством и обеспечено силой его принуждения. В Европе О. был основным источником права до XVI в. В настоящее время его роль в разных правовых системах мира (и отдельных государствах) неодинакова. В РФ О. признается вспомогательным источником права; законодательство РФ иногда прямо отсылает к О. или допускает их применение. Так, в ГК РФ содержатся ссылки на обычаи делового оборота (ст. 6), национальный О. (ст. 19) и местный О. (ст. 221, 309, 311, 312, 314-316, 406, 421). Совокупность правовых О. образует обычное право.
